Agreement to Terms

1.

All access of any area of https://learn.nyc.gov.sg ("The Website") is governed by the terms and conditions below ("Terms"). Please read these Terms carefully before proceeding further. If you do not accept any of these Terms, you are advised to exit immediately. Continue only if you accept these Terms. You shall be deemed to have accepted these Terms if you choose to continue to access The Website. In these Terms, the words "we", "our" and "us" refers to the Government of Singapore.

You understand that any non-compliance with these Terms, whether intentionally or otherwise, may result in action being taken against you, including but not limited to a claim for compensation for any damage or loss of any kind caused by such non-compliance (direct or indirect).

Proprietary Rights

The Website is an official Government of Singapore (“the Government”) website. It is owned and operated by the National Youth Council (“NYC”).

4.

The materials located on The Website including the source code, pages, graphics, images, statistical data, reports, charts, graphs, audio, video, information and documentation (“the Contents”), are protected by copyright, trademark and other intellectual property rights. All rights, title and interest in the Contents are owned by, licensed to or controlled by the Government.

Apart from any fair dealings permitted in law, no part of The Website may be reproduced or reused for any commercial purposes whatsoever without our prior written permission.

Use On Behalf Of Organisation

If you use The Website or expressly agree to these terms and conditions in the course of a business or other organisational project, then by so doing you bind both:

(a)

yourself; and

(b)

the person, company or other legal entity that operates that business or organisational project, to these terms and conditions, and in these circumstances references to "you" or “your” in these terms and conditions are to both the individual user and the relevant person, company or legal entity, unless the context requires otherwise.

Access To The Website

The accessibility and operation of The Website relies on technologies outside our control. As such, we do not guarantee continuous accessibility or uninterrupted operation of The Website.

We reserve the right to:

suspend, terminate or vary The Website or its operating hours;

You shall be liable for all transactions conducted under your account if you disclose to or share your account with anyone else (regardless whether you receive payment for it) or you have compromised your account in any way.

You shall under no circumstances submit, upload or transfer any unauthorised files, codes, scripts (including but not limited to viruses, Trojan Horses and the like), documents and information in the course of using The Website or its related e-services that are provided by us.

Use of Data

Any personal data belonging to you and/or your organisation shared with us (“Personal Data”) through The Website may be collected, used and disclosed to or by the Government to the extent that it is necessary for the effective delivery of public services.

Personal Data may be disclosed to other Government agencies carrying out public functions unless such disclosure is prohibited by law. You shall be presumed to consent to such disclosure of Personal Data.

19.

Personal Data will not be disclosed to entities that are not Government agencies except where such entities have been authorised to act on behalf of the Government agencies and the Personal Data is necessary in order for the entities to do so.

20.

We shall secure all electronic storage and transmission of Personal Data with appropriate security technologies.

21.

You warrant that all Personal Data submitted through The Website is complete, accurate and consistent with any supporting documents that are submitted in support of any application.

22.

As far as practicable, Personal Data that had been previously supplied by you to Government agencies will be displayed to you on The Website. You shall:

(a)

ensure that the Personal Data is complete, accurate and updated; and

(b)

if there are any inaccuracies in the Personal Data, update your personal particulars on The Website under your profile, or submit a request here (https://go.gov.sg/nyclmsform), whichever is applicable.

Inaccurate, incomplete or outdated Personal Data may result in:

(a)

delays in processing or rejection of your transactions through The Website; and/or

(b)

you being liable for costs incurred due to your submission of false or incorrect information.

Links from this Website to other websites

This Website contains hyperlinks to websites which are not maintained by us. We are not responsible for the contents of those websites and shall not be liable for any damages or loss arising from access to those websites. Use of the hyperlinks and access to such websites are entirely at your own risk.

Hyperlinks to other websites are provided as a convenience to the user. In no circumstances shall we be considered to be associated or affiliated in whatever manner with any trade or service marks, logos, insignia or other devices used or appearing on websites to which this Website is linked.

Permission To Use Website

(a)

(b)

print pages from The Website for your own personal and non-commercial use, providing that such printing is not systematic or excessive;

(c)

(d)

use The Website services by means of a web browser; and

(e)

download documents or media from The Website via a web browser, where such documents and media are intended to be downloaded for offline viewing, subject to the other provisions of these terms and conditions

You grant to us a worldwide, irrevocable, non-exclusive, royalty-free licence to reproduce, store and publish your content on and in relation to this website and any successor website; The Website will restrict access to your content to you or your organization only, except for the parts of your content you make publicly accessible using functionality available on The Website.

cause annoyance, inconvenience or needless anxiety to any person.

Fees

There are currently no fees for using any part of The Website. We reserve the right to introduce new fees from time to time. We are not responsible for any fees charged by any other Internet site.

Applicable Laws

Use of The Website and these Terms shall be governed by and construed in accordance with laws of the Republic of Singapore for every purpose. Any claim relating to use of The Website shall be heard by the Singapore Courts.

Variation

We may revise these Terms at any time by updating this page. You should visit this page from time to time and review the then current Terms because they are binding on you. We may modify or discontinue any information or features that form part of The Website at any time, with or without notice to you, and without liability whatsoever to any user.
